Terms of Service

These Terms of Service ("Terms") govern your access to and use of SCRMAI ("the Service"), operated by [LEGAL ENTITY NAME], [REGISTERED ADDRESS], India ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

SCRMAI is a customer relationship management platform for educational institutes, covering enquiry and admission management, student records, attendance, fee collection, communication and analytics. Features available to you depend on your subscription plan.

2. Accounts and eligibility

  • You must be authorised to act on behalf of the institute you register.
  • You are responsible for the accuracy of your account information and for all activity under your account.
  • You are responsible for safeguarding credentials. We provide TOTP two-factor authentication and strongly recommend enabling it for every user.
  • You must promptly notify us of any unauthorised use of your account.

3. Free trial

New accounts receive a 14-day free trial with access to plan features. No payment method is required to begin a trial, and no charge is made automatically when the trial ends. If you do not subscribe, access to the Service ends and your data is retained for a limited period before deletion in accordance with our Privacy Policy.

4. Subscriptions, billing and AI credits

  • Subscriptions are billed monthly in advance through Razorpay, in Indian Rupees.
  • Listed prices are exclusive of GST, which is applied at billing.
  • AI features are metered using prepaid AI credits, purchased separately from your plan. Credits are consumed as AI features are used.
  • You may upgrade, downgrade or cancel at any time. Changes take effect as described in our Refund Policy.
  • We may change prices with at least 30 days' notice to the email on your account. Changes do not affect the current billing period.

5. Your data

You retain all rights to the data you and your users put into the Service, including student, parent and staff records ("Your Data"). You grant us a limited licence to host, process and transmit Your Data solely to provide and support the Service.

You can export Your Data at any time in CSV or PDF format from every major entity in the product, without contacting us.

6. Your responsibilities regarding personal data

You are the controller of the personal data you upload, including data about students who may be minors. You are responsible for:

  • Having a lawful basis to collect and process that data, including any consents required from parents or guardians;
  • Ensuring your communications comply with applicable law and with the policies of the channels used, including Meta's WhatsApp Business policies;
  • Honouring requests from data subjects, using the access and export tools we provide.

7. Acceptable use

You agree not to:

  • Use the Service to send unsolicited bulk messaging in breach of applicable law or channel policies;
  • Upload unlawful, infringing or malicious content;
  • Attempt to gain unauthorised access to the Service, other accounts, or related systems;
  • Reverse engineer, resell or sublicense the Service except as expressly permitted;
  • Use the Service in a way that impairs its availability for other customers.

Public forms are rate limited. We may suspend accounts engaged in abuse, with notice where practicable.

8. Third-party services

The Service integrates with third parties including Razorpay (payments), Meta (WhatsApp Cloud API and Lead Ads), Twilio (SMS), Vapi (voice calling) and Google (Calendar). Your use of those services is governed by their own terms, and their availability and charges are outside our control. Fee payments are processed by Razorpay and settle directly to your bank account; we do not hold your funds at any point.

9. AI features

AI features produce scores, suggestions, drafts and generated text. They are decision aids, not decisions. You are responsible for reviewing AI-generated content before it is sent to parents or students, and for any action taken on the basis of an AI score or risk flag. We do not warrant that AI outputs are accurate or complete.

10. Availability and support

We aim to provide a reliable service but do not guarantee uninterrupted availability. Planned maintenance will be notified where reasonably practicable. Support is provided by email at hello@scrmai.in.

11. Suspension and termination

You may cancel at any time from within the product. We may suspend or terminate access for non-payment, breach of these Terms, or where required by law. On termination you may export Your Data; after the retention period described in our Privacy Policy it is deleted.

12. Disclaimers and liability

The Service is provided "as is" to the extent permitted by law. To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve months preceding the claim. We are not liable for indirect, incidental or consequential losses, including lost admissions, lost revenue or loss of data beyond our reasonable control.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Changes to these Terms

We may update these Terms. Material changes will be notified to the email on your account at least 30 days before taking effect. Continued use after that date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of India, and the courts at [CITY], [STATE] have exclusive jurisdiction.
